THE BIG HOLE IN THE PRIVACY EO — The Biden administration described its executive order on Wednesday as “the most significant executive action any president has ever taken to protect Americans’ data security.” Privacy hawks, though, say it’s not enough.

The executive order seeks to block companies from selling Americans’ sensitive information to foreign adversaries, with a tentative list of prohibited nations including China, Russia, Iran, North Korea, Cuba and Venezuela…

The privacy-focused senator [Wyden], who proposed legislation in 2022 similar to the executive order, isn’t alone in this concern. Brandon Pugh, policy director focused on cybersecurity at the free market think tank R Street Institute, said the executive order only handles the most egregious threats to national security, and the specifics on how it will play out will depend on the specific set of rules developed around the order.
