After Chevron

In June 2023, the U.S. Supreme Court reversed its seminal decision in Chevron v. Natural Resources Defense Council, which for the last four decades has governed how courts are supposed to handle cases involving the interpretation of federal statutes by the executive branch. As one R Street Institute (RSI) scholar noted on the day of the ruling:

“With the Court’s decision in Loper Brightthe [Chevron] doctrine has been abandoned altogether.”

As a think tank focused on solving complex public policy challenges through free markets and limited, effective government, RSI strives to offer pragmatic, real solutions that foster American innovation, bolster competition, and safeguard individual liberty—all with the understanding that life in a democratic society sometimes requires compromises that don’t necessarily represent first, best solutions.

In the new post-Chevron policy ecosystem, scholars across RSI’s issue areas have been analyzing and speaking with media, policymakers, and others about how to think about approaching the public policy ecosystem going forward. Below is a collection of their work.
